1. Introduction

2. Scope of Services
We provide assistance related to tenant eviction matters subject to a fair usage policy. We reserve the right to charge a fee if a detailed review of a matter is required to provide further advice. By using our eviction services, you agree that any subsequent applications for enforcement action in relation to a possession order will be made by us and carried out by our appointed certificated enforcement agents, or where applicable, by county court bailiffs, accompanied by our agent as your representative. We can at any time assign, transfer, charge, subcontract or deal in any other manner with all or any of our rights under these Terms and Conditions and can subcontract or delegate in any manner any or all of our obligations to any third party. You must not, without our prior written consent, assign, transfer, charge, subcontract or deal in any other manner with all or any of your rights or obligations under these Terms and Conditions.
3. Fair Usage Policy
Our service is offered to assist as many users as possible. Excessive use or repeated enquiries beyond the scope of fair usage may result in our requiring a fee for further assistance. We retain sole discretion in determining whether fair usage limits have been exceeded.
4. Disclaimer
We are not a firm of solicitors. We do not hold ourselves out to be such, nor do we conduct litigation or hold the requisite permissions to do so. Our role is limited to providing solutions to landlords, property owners, and property agents. For matters requiring litigation, legal representation or further expertise, we may refer you to a panel of carefully selected solicitors or individuals who specialise in property law and are authorised to perform these functions under the Legal Services Act.
5. Fees and Payment
If additional services or detailed reviews are required, fees will be communicated to you before proceeding. Payment must be made in advance unless otherwise agreed. Fixed Fees will relate to uncontested matters only. Should a matter be defended, further fees may be charged. Payments are non-refundable unless we fail to provide the services in their entirety and are at fault for such failure (where the failure is not our fault, no refund will be made). If you terminate your instructions or we stop acting for you within the terms of this agreement, you will still have to pay our charges and expenses up to the date that we cease acting, including costs for removing our name or our lawyer’s name from the court record if court proceedings are involved and transferring our files to you or another advisor. We reserve the right to initiate debt recovery procedures in the event of non-payment. Clients who pay late may be required to pay compensation and penalty interest. We further reserve the right to apply charges where necessary once a late default on an invoice occurs. If you do not pay within the period set out in our invoice, we can decline to act or suspend any further provision of the Services and cancel any future services which have been ordered by, or otherwise arranged with, you. Where the client is a limited company or LLP, by instructing London Tenant Evictions the directors or partners accept joint and several liability for costs, fees and charges due and payable as a result of their instruction being actioned.. All payments must be made in Pounds Sterling.
6. Distance Selling Regulations
Where applicable, your use of our paid services is subject to the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013. You have the right to cancel any paid services within 14 days of entering into a contract unless we have begun providing the service with your consent.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from your use of our services. This includes but is not limited to loss of profits, property, or legal outcomes. While we carefully select our panel of legal professionals, we hold no liability, nor will accept any liability in connection with any services provided by these.
8. Complaints Policy
Our complaints policy applies only to paid services. If you are dissatisfied with any aspect of our paid services, please contact us in writing at info@londontenantevictions.co.uk . We aim to acknowledge receipt of your complaint within 5 working days and aim to resolve it within 28 days. If the matter is not resolved to your satisfaction, you may be referred to an appropriate independent body.
